The application of temporary protection in the European Union in the context of the Russian aggression against Ukraine. An unprecedented response to an exceptional situation

The Russian aggression against Ukraine in February 2022 has led to the unanimous decision of the Council to activate, for the first time in the history of the EU, the Temporary Protection Directive 2001/55/EC. This paper is dedicated to the study of the application of this Directive, two years after its implementation due to the conflict in Ukraine, and also taking into account the reform proposals presented in the context of the European Pact on Migration and Asylum. To date, this measure has proven to be effective in managing the massive influx of people displaced by the conflict in Ukraine, providing safe and rapid means of protection and access to a set of rights. However, it appears that its implementation is more a reflection of the exceptional nature of the situation in an area strongly conditioned by political consensus, as the reception of a massive influx of people in need of protection.
