It is not easy to determine the extent and limits of the right to religious freedom when it conflicts with the right to life: ¿does the minor have the right to refuse a vital treatment (a blood transfusion) because of his/her religious believes? ¿Do his/her parents have the right to not authorise that vital treatment because of their religious believes? The Spanish Constitutional Court answered these questions in the sentence 154/2002. First, it recognised that minors have the right to religious freedom, though it does not necessarily means that they have the right to refuse a vital treatment. Second, it stated that the parents can not invoke their religious believes to obstacle health care for their child, but they have the right to not authorise a vital treatment for him/her because of their religious believes.
