La humanización del Derecho internacional. Problemas y desafíos

Resumen

A partir de la idea de que, en acto, existe un proceso de humanización del derecho internacional, este trabajo mira a desmontar la relación dicotómica entre justicia y humanidad presente en la cultura jurídica. Después se observa la evolución de la protección internacional de los derechos y del Derecho humanitario, donde se identifican distintos significados de humanidad: como título universal de derechos, como criterio identificador del portador del deber de proteger los derechos, como principio de protección de la dignidad de los enemigos de la humanidad en la justicia penal internacional, y como proyecto de aliviar el sufrimiento durante las guerras. Se sostiene la tesis de que en el contexto internacional emerge un modo de entender la relación entre justicia y humanidad que supera su relación dicotómica y se señalan algunos desafíos todavía por impulsar.
