La presente contribución aborda el tratamiento jurídico de la gestación subrogada por la jurisprudencia internacional; especialmente la europea. Su análisis nos permite identificar una serie de principios y de derechos fundamentales a partir de los cuales puede interpretarse y aplicarse una normativa interna divergente e incompleta en la mayoría de los casos. Gracias a esos principios y derechos pueden darse respuesta jurídica a los problemas legales que plantea un fenómeno trasnacional con un importante componente ético.
