The victim in the face of discrimination and gender-based violence: reparations in the work of the International Criminal Court

Resumen
La violencia de género, como manifestación más extrema de la discriminación de género, está presente de diversas formas en los crímenes internacionales ante la Corte Penal Internacional (CPI). Este texto examina críticamente la evolución de la jurisprudencia de la Corte en el ámbito sustantivo y en materia de reparaciones por crímenes internacionales contra mujeres y niñas y el reflejo o carencia de una perspectiva de género en los casos de violencia contra ellas, así como en los principios generales de reparaciones. Este análisis se realiza revisando los casos centrales en los que la CPI ha emitido órdenes de reparación: los casos Lubanga, Katanga, Al Mahdi, Ntaganda y Ongwen, así como algunos otros avances interpretativos en la materia. Finalmente, se presentan reflexiones sobre la actuación de la CPI desde una perspectiva de género y la realización efectiva del derecho a reparaciones transformadoras para mujeres y niñas en todo el mundo.
