The resolution 1970 (2011) of the Security Council redirected the investigation of the international crimes which could have been committed in Lybian territory to the International Criminal, by the article 13 (b) of the Statute of Rome. On March 16, the Court issued the first three warrant decisions against Lybian nationals, included Colonel Gaddafi and his son. This article describes the consequences of those decisions, analyses the precedents in this kind of issues (mainly, the Al Bashir case) and examines the value of these referrals from the Security Council to the International Criminal Court and how the States react to them.
