The purpose of this paper is to defend and argue for the existence of a material but invisible constitution of the international community. Its constitutionality derives from three relevant facts: first, the formal validity of the norms of international law; second, the social recognition in the international community that can be qualified as an opinio iuris constitutionis; and third, from the cultural practices existing today with respect to such norms that corroborate the content and/or functions that this constitution plays for that community.
