The case of the Marshals Islands: colonialism, nuclear weapons and environmental justice

This paper highlights the limitations of the international order in the context of the Marshall Islands affair and the U.S. nuclear testing program. Its impacts on human rights and the environment make it - in essence - a very illustrative case of what is not environmental justice. The disproportionate occupation of the atmosphere as common space by the United States and other States, to deposit their greenhouse gas emissions, may eventually eliminate the islands, and with them, the issue before the Court.

RIGHTS TRANSFER
