This article analyses Protocol No. 16 to the European Convention on Human Rights, which allows ratifying States to allow the highest courts of a State to request advisory opinions from the European Court of Human Rights on questions relating to the interpretation and application of the 1950 Rome Convention or its Protocols. In particular, the procedural and other issues that the Protocol does not fully resolve and/or are likely to give rise to problems of practical application are analysed.
