A Personalistic Approach to Human Rights: Shifting Prevailing Philosophical Assumptions

El objetivo de este artículo es analizar las presuposiciones filosóficas predominantes en las interpretaciones de los derechos humanos y cómo éstas han brindado una visión reduccionista y parcial del ser humano y del concepto de racionalidad. Este paradigma excluye las experiencias y las inquietudes morales de un segmento significante de la población global, y también evita abordar las demandas subyacentes detrás de los debates sobre derechos humanos. En respuesta a esta situación, este artículo introducirá un enfoque filosófico personalista como una alternativa capaz de explicar de qué manera el concepto de ‘persona’, como un ser relacional, puede enriquecer la racionalidad predominante en el Derecho Internacional de los Derechos Humanos. Esta investigación sugiere que prestando atención a las relaciones intersubjetivas, a los significados, y a un concepto más amplio de ‘experiencias humanas’, se puede proveer una comprensión más profunda sobre la persona humana y se ayuda a formular discusiones sobre derechos humanos en términos más diversos e inclusivos.

CESIÓN DE DERECHOS
Al enviar el artículo para su evaluación y posterior publicación en la revista Persona y Derecho, el AUTOR cede de manera exclusiva los derechos de comunicación pública, reproducción, distribución y venta para su explotación comercial a la Universidad de Navarra a través de su Servicio de Publicaciones, por el plazo máximo legal vigente -toda la vida del autor y setenta años después de su muerte o declaración de fallecimiento-, en cualquier país, y en cualquiera de las actuales y futuras modalidades de edición tanto en versión impresa como electrónica.
