On December 19, 2005, the International Court of Justice (case on Armed activities in the territory of the Congo) condemned Uganda for the illegal exploitation of the Democratic Republic of the Congo’s natural resources. Its conclusions were not as extensive as desirable, since although the Court affirmed the consuetudinary character of the principle of permanent sovereignty on natural resources, it finally decided on the basis of Humanitarian International Law. This article focuses on the Court reasoning and its reluctance to clarify and consolidate the principle.
