This essay aims to analyze the anthropological dimension of the theory of dominium following the treatment and solution provided by Domingo de Soto in De dominio and in De iustitia et iure. We will analyze dominium as a species of natural law based on the human condition of creature, confronting it with the legal institution of slavery. In an introductory fashion, we place the solution provided by Soto in the context of the American debate on the status of Native Americans exemplified by the controversy between Juan Ginés de Sepúlveda and Bartolomé de las Casas.
