Información y derechos de la personalidad en España; o la incoherencia interceptiva de un tribunal constitucional

Abstract
Es ya muy numerosa la jurisprudencia de este órgano jurisdiccional sobre los casos de conflicto entre derecho a la información y derechos de la personalidad, y son también muchos los puntos coincidentes de las sentencias que el tribunal ha fallado, sin embargo, no faltan tampoco los aspectos, si no contradictorios, cuando menos ambiguos, que han dado lugar a un justificable desconcierto en el ámbito periodístico de los preceptos constitucionales? ¿responde quizás a un defecto de fabricación de las normas que han desarrollado los derechos que aquí están en juego? ¿o habrá que considerar la presencia de elementos extra jurídicos que han condicionado su interpretación?

RIGHTS TRANSFER
By submitting the article for evaluation and subsequent publication in Communication & Society, the AUTHOR exclusively assigns the rights of public communication, reproduction, distribution and sale for commercial exploitation to the University of Navarra through its Publications Service, for the maximum legal term in force -the entire life of the author and seventy years after his death or declaration of death-, in any country, and in any of the current and future edition modalities, both in print and electronic versions.
