The article reviews the evolution of EU legislation on migration to finally focus on the most controversial points of 2088/115/CE Directive on the return of illegal immigrants: the procedure or return and expulsion, the detention and the child interest. In this analysis, the author gives a fundamental rights perspective as the basic legislation to follow. In the author’s point of view, the regulation of migration must be done according to the requirements that the new world situation demands, ie, from a much broader perspective.
