Neoconstitutionalism, Justice and the Principle of Proportionality

Abstract
Las Constituciones elaboradas a partir de la II Guerra Mundial introdujeron una teoría material de la justicia basada esencialmente en el reconocimiento de la dignidad humana y en el respeto a los derechos fundamentales. Sin embargo, pronto comenzó a admitirse que los derechos fundamentales podían ser restringidos no sólo para preservar otros derechos, sino también bienes colectivos, tesis que ha alcanzado su mayor elaboración teórica en la obra de Robert Alexy. El principio de proporcionalidad ha cobrado especial relevancia como instrumento capaz de controlar que la aplicación de las medidas restrictivas dé lugar a excesos o arbitrariedades. Este principio disciplina el razonamiento y la argumentación jurídica desde una perspectiva formal. Surge así la duda de si la irrupción del principio de proporcionalidad ha supuesto la transformación de la teoría material de la justicia propia del neoconstitucionalismo en una teoría procedimental de la justicia. El presente trabajo pretende despejar dicha incógnita y proponer una concepción de los derechos fundamentales fiel a la teoría de la justicia que se halla en la base del neoconstitucionalismo.
