On the Immediate Normative Value of the Constitution. STC 80/1982, 20th December

Abstract
La entrada en vigor de la Constitución del 78 parece haber supuesto un cambio revolucionario, en relación tanto con las llamadas "Leyes fundamentales" del régimen inmediatamente anterior y también con toda nuestra tradición constitucional, en lo que al valor normativo inmediato de la Constitución respecta. Y así, lejos de tener mero valor programático, las normas constitucionales serían auténticas normas jurídicas inmediatamente aplicables. A la luz de la sentencia aquí analizada resulta, sin embargo, que tal cambio no ha sido tan radical como pudiera parecer. Y ello no sólo porque la Constitución tiene valor normativo inmediato parcialmente y no en su totalidad, sino también porque algunos de los derechos reconocidos en los artículos que carecen de tal valor normativo inmediato -39 a 52- bien pueden considerarse desarrollo y/o concreción constitucional de los que sí gozan de tal valor. Ante tal pervivencia parcial de la distinción "Leyes fundamentales/auténticas leyes" y semejante "inconstitucionalidad constitucional", por así llamarla, se concluye en la necesidad de un afirmación más rotunda del valor normativo inmediato de las normas constitucionales.
