The first resolution of the Spanish Constitucional Court which applied the Journalist's Conscience Clause Act

Abstract

On December 2002, the Spanish Constitutional Court has published the first resolution which applied the Journalist’s Conscience Clause Act. This sentence increase constitutional protection to conscience clause, meanly in two aspects: a) From the point of view of conscience clause content: it’s recognized a diversity of actions; the only condition for their legitimacy is proportionality to aim of journalist’s moral integrity. b) From the point of view of procedure, the most relevant question is: the journalist can leave the enterprise before judicial resolution, if the reason of leaving is the clause of conscience.
